                MEDICAL HISTORY:


            This purchase agreement is a legally binding contract for the sale of one kitten / cat as fully described at the end of this document between HollywoodSphynx Cattery (the SELLER) and _______________________ (the BUYER) and entered into on this _______ day of ____________, 20_______.
1.  Primary Warranty of Health.

The SELLER provides a 48-hour limited guarantee that the kitten / cat is in good health at the time of purchase. The SELLER also warranties that the kitten is free of the feline leukemia virus (FeLV) and the feline immunodeficiency virus (FIV) at the time of purchase. In order to validate the warranty, the BUYER must take the kitten / cat to a licensed veterinarian within 48 hours of the date of purchase, excluding holidays and weekends, for a health examination.  This examination shall be at the BUYERS expense. If, in the opinion of the veterinarian, the kitten / cat is suffering from any illness or medical condition, the BUYER must notify the SELLER immediately. In this situation medical treatment may only be authorized by the SELLER.  At the SELLER'S discretion treatment may be authorized, the cost to be born by the SELLER, the kitten / cat may be returned to the SELLER for a full refund, voiding this agreement, or the kitten / cat may be returned to the SELLER and exchanged for a comparable kitten / cat.  Note to BUYER - Keep in mind that most veterinarians have never even seen a Sphynx cat, much less treated one and are uneducated about our breed. If the veterinarian finds the kitten / cat to have a life-threatening illness, he should write and sign a short note on his letterhead stationary explaining his findings.  This guarantee will be void if the kitten / cat is exposed to any other animal between delivery to the BUYER and the examination.  Note to BUYER - It is highly recommended that the above kitten / cat be quarantined during that 48-hour warranty period. Finally, under NO circumstances is the kitten / cat allowed to be destroyed prior to notification of the SELLER, regardless of the kitten's / cat's medical condition or injuries.
2.  Secondary Warranty of Heath.

           If the kitten / cat should die within a year of the date of purchase due to a congenital or hereditary defect, the SELLER will replace the kitten / cat with another kitten / cat of equal or better quality at no cost to BUYER. The SELLER must receive proof of the defect in the form of a complete autopsy report completed by a licensed veterinarian and performed at the BUYERS expense. The SELLER will make every attempt to replace the kitten / cat with a kitten / cat of equal or better color,
marking, and quality in a timely manner.

3.  Transportation.

We prefer that you come in person to pickup the kitten / cat.  When possible, we will deliver it to an agreed location at a reasonable distance from the SELLER'S place of business.  If the kitten / cat must be transported by a party other than the SELLER, such transportation will be at the discretion and at the cost of the BUYER.  The SELLER is not responsible for illness, injury, or death caused by or during shipping.  Further, due to possible exposure to other animals beyond the SELLER'S control, the quarantine requirement of clause 2, Primary Warranty of Health, will be assumed to be violated.
4.  Pre-Sale Medical Treatment.

The SELLER will have completed all of the age-appropriate vaccinations, worming, and medical examinations by the time of purchase.  The kitten / cat may have been altered by the time of purchase.  If the BUYER wishes to take receipt of their kitten before altering is age-appropriate then it must be performed at the BUYERS expense within 90 days of taking possession of said kitten unless the kitten has been sold as UNalter.  If proof of such altering is not provided to SELLER within this 90 day period, this purchase shall be void and ownership of the kitten / cat will revert to the SELLER.  In this case, the BUYER will not be entitled to any compensation or refund of purchase price and the kitten / cat will be returned to the SELLER. Within this proof the cat must be scanned for it's  prior to delivery implanted micro-chip I.D. which must be included in type not hand writing on the face of the same document as proof of altering which must also be signed
by the veterinarian who performed the surgery.
5.  Post-Sale Medical Treatment.

If the BUYER chooses to vaccinate the kitten / cat for feline infectious peritonitis (FIP), ringworm, feline leukemia virus (FeLV), or feline immunodeficiency virus (FIV), all warranties of health are void. Also, SELLER will not warranty the kitten / cat against any adverse reactions to future vaccinations or surgeries.
6.  De-Clawing.

The BUYER understands that de-clawing is a mutilation involving the amputation of a large portion of the kitten's / cat's toes, which is likely to alter the kitten's / cat's temperament and general well-being.  BUYER agrees that the kitten / cat will not be "de-clawed" under any circumstances.  Doing so will constitute breach of this contract on the part of the BUYER.
7.  Other Seller Obligations.

The SELLER will provide the BUYER with the kitten's / cat's registration from The International Cat Association (TICA) in a timely manner ONLY when full breeding rights are purchased.
8.  Seller's Post-Sale Rights

   a)  The BUYER will provide the SELLER with the primary address where the kitten / cat will be housed along with any other address where the kitten / cat may be housed from time to time.
   b)  The BUYER will provide the SELLER with the name and address of the veterinarian primarily responsible for the kitten's / cat's medical care.  The BUYER will also authorize the veterinarian primarily  responsible for the kitten's / cat's medical care to respond to
any inquiries from the SELLER to his fullest ability.
   c)  Upon written request from the SELLER, the BUYER shall make all the kitten's / cat's medical records available to the SELLER within 7 days of notification.
   d)  With at least 48 hours verbal or written notice from the SELLER, the BUYER will allow the SELLER to visit with, handle and otherwise inspect the kitten / cat and also inspect the area where the kitten / cat is housed and any other areas to which the kitten / cat has access.
9.  Buyer's Responsibility.

The BUYER accepts the responsibility of caring for the kitten / cat and will provide properly for its welfare. BUYER agrees to keep the kitten / cat indoors at all times except during normal transportation from place to place in a clean and pleasant environment, un caged, and with proper nutrition, health care (including yearly veterinarian examinations and vaccinations), companionship, and adequate space for exercise. The kitten / cat will only be allowed outdoors while on a leash or in a closed carrier and while under close supervision. The BUYER agrees to provide a suitable warm place for the kitten / cat at ALL times. Note  - With the lack of fur, Sphynx are susceptible to insect bites and possibly even the sun. Keep in mind that dangerous, life-threatening organisms can live on sidewalks, grass, the bottom of your shoes, etc., and any kitten / cat can easily pick these up. Due to the lack of fur, Sphynx are more easily chilled than some other breeds. We also suggest that you clean litter boxes daily and provide at least one litter box per each two cats. We use and recommend  The Worlds Best Cat Litter 100% natural cat litter.
10.  Subsequent Transfers of Ownership.

     Should the BUYER be unable or unwilling to keep the kitten / cat for any reason, including the incapacitation or death of the BUYER, the SELLER must be contacted immediately.  The SELLER shall have first option to purchase the kitten / cat for a reasonable sum.  The SELLER may also assist in finding a suitable new home for the kitten / cat.  This notification obligation and first right of refusal remains in effect for the entire life of the kitten / cat.  The BUYER agrees that under no circumstances will the kitten / cat be sold, leased, or given to any pet shop, animal shelter, research laboratory or similar facility.  Note - the SELLER will not ask questions as to why
you can no longer provide care for the kitten / cat.
11.  Neglect.

The BUYER understands that if the kitten / cat is found to be neglected or mistreated, the SELLER shall have the right to reclaim the kitten / cat without compensation or refund of the purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for periods in excess of 48 hours, lack of proper sanitary facilities, being caged, being provided poor diet, or being kept in poor health. Mistreatment shall include, but is not limited to: lack of proper food, lack of proper medical care, lack of fresh water, and any form of physical abuse. BUYER will be responsible for any veterinary bills directly incurred as a result of any neglect or mistreatment.
12.  Buyer's Other Obligations.

   a)  BUYER agrees to never use a clay-based litter, as these are known to cause fatal health issues.
   b)  BUYER understands that if any pictures of the kitten / cat are
posted on or in any bulletin or web site of any kind where animals are being sold,
the full paper name including "Hollywoods" must be posted in conjunction with the picture.
c)  BUYER agrees to provide adequate scratching posts and regular nail trimming.
      d)  BUYER agrees to provide frequent baths and ear cleanings along with daily eye cleaning (as required). These kittens / cats bodies produce oil, which dirt clings to. Failure to bathe and provide weekly ear cleanings may result in skin issues and even deadly ear infections.
The kitten / cat will be delivered freshly bathed with trimmed nails and freshly cleaned ears.
13. Pre-sale / Breeding rights

If after any or all payments on a kitten / cat  have been made the SELLER feels that the BUYER is acting in any way hostile or threatening  towards his person or business / reputation or believes the kitten / cat my be in danger in the potential BUYERS possession it will be considered a Breach of Contract. If  kitten / cat that is agreed upon to be sold as UNalter is believed at any time before leaving the SELLERS possession to be not of breeding quality the SELLER retains full right to keep said kitten / cat without any prior notice to BUYER and replace it with one that is believed by the SELLER to be of breeding  quality. The SELLER has a period of one year to replace such kitten from their own stock or that of a breeder that the SELLER believes to be of equal and reputable quality.  If a kitten / cat is sold as UNalter the BUYER agrees that NO kittens born out above said kitten / cat will be sold UNaltered for ANY reason what so ever (First Generation Restriction). If it is found that this has been done it will be seen as a Breach of Contract.

14.  Hairlessness.

It is understood that degree of hairlessness in Sphynx vary from cat to cat and that no Sphynx is completely hairless. It is understood that hormones, climate, and genetics play an important role in hairlessness and that even though a Sphynx kitten may be completely or almost hairless when sold, it is possible that said kitten could develop some hair after being neutered / spayed or as it grows older. It is also impossible to guarantee that any Sphynx kitten / cat will not grow some hair at some point in the future.
15.  Breach of Contract.

If the BUYER fails to keep any of the obligations in this contract, the BUYER shall be in breach of contract.  In this case and at the SELLER'S option, ownership of the kitten / cat shall revert to the SELLER without any compensation or refund of purchase price to the BUYER.  The SELLER also shall have the option of charging the BUYER a fee of $500 for each breach of this contract.
16.  Sever ability.

If any court determines that any provision of this agreement is invalid or unenforceable, any invalidity or un enforceability will affect only that provision and will not make any other provision of this agreement invalid or unenforceable and such provision shall be modified, amended, or limited only to the extent necessary to render it valid and enforceable.

17.  Court of Jurisdiction and Legal Fees.

Any legal action which may arise under the terms of this contract will be brought in Sacramento County, California, USA. If the court finds in SELLER'S favor, BUYER shall be liable for any court costs and related charges including attorney's fees associated with SELLER enforcing the terms of this contract.  In signing this document, BUYER acknowledges that he / she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State of California shall be controlling.
BUYER and SELLER agree to ALL of the above stated terms.
